Until recently, our nation's capital was a monument to
anti-freedom. The city had in place an outright ban on private
handgun ownership. It was arguably the strictest ban anywhere in
America. But, earlier this March, the District of Columbia
District Court struck down the thirty-one-year-old ban. This
court decision is really big news and has consequences reaching
far beyond the capital. Opponents of gun ownership have argued
that the "Right to Bear Arms" in the Bill of Rights is a
"collective" right that is applicable only to various States,
e.g., that it guarantees only that the states have the right to
form a national guard, without granting any rights to "the
people," i.e., individual citizens. This court decision clearly
rejects the notion that the second amendment applies only
collectively to states and explicitly states that the amendment
applies to individual citizens. This decision is also important
since it will likely matter across the entire country. First,
the decision is likely to be revealed by the supreme court. If
(when) the supreme court backs the decision, no governmental
entity within the US will be able to ban private gun ownership.
Second, even if the Supreme Court does not get the chance to
review the decision, the authority of the DC District Court's
decisions can extend beyond the borders of Washington, DC and
encompass the whole nation.
